1) BID PROPOSALS DO NOT INCLUDE FLOOR PREP. Floor preparation calculated at time and materials to be charged as follows: $85.00/HR/Man + Materials needed. For jobs with excessive (>16 man hrs.) prep work needed, special rates available, please ask.
2) All Furniture, Appliances, Toilets and/or belongings to be moved by customer unless otherwise specified in Bid Proposal. Electronics and cable to be removed by customer. If moving of belongings is necessary to facilitate the job, a charge of $85.00/HR/Man will be charged (2 HR/Man Minimum) or $150.00/Appliance or Toilet. Specialty appliances/utilities moved by others.
3) Customer Own Materials: For those customers supplying their own materials we advise you as follows: Be sure to verify material quantity, quality and color prior to having us pick up or work commencement to avoid installation delays or possible additional labor charges as outlined in item #7 below.
4) We do not guarantee floors when moisture exists or develops. Concealed sub-floor problems, which require additional expenditures by Michael Renga Flooring, will result in an additional charge to the customer.
5) During the removal and replacement of existing items: Appliances, toilets, moldings, THRESHOLDS, existing transitions & trim, doors, closet doors - Customer to be responsible for adjustments & re-installation if we are unable to reinstall due to size variances, deterioration of materials, poor original installation or any other issues out of our control.
6) Extra trips to be charged at $450.00 when required or requested by customer. Night/Weekend/Holiday/Overtime work additional 50% Labor Rate
7) Job not ready, schedule changes or labor cancellations due to reasons not caused by Michael Renga Flooring require a 1 week notice. Without 1 week notice, customer will be charged a $350.00 rescheduling fee. Hourly rates at $85.00/HR/Man will apply to down time when jobs are put on hold or our work is unable to proceed due to other trades work being done.
8)All job sites must provide adequate access, power, water and lights. We do not offer additional lighting.
9) Customer is responsible for informing Michael Renga Flooring of job site entry if customer will not be present upon arrival.
10) Commercial/Residential Job Sites are to be properly cleaned and emptied of other trade's equipment/belongings prior to our arrival. If not, there will be a $350 rescheduling fee.
11) Customer needs to be present upon completion to let us know of any questions they have regarding work completed. Final payment is due at this time.
12) Job timelines may change for several reasons. MRF Inc. will always do its best to keep jobs on schedule. Absolutely no compensation will be made or offered for lodging or other personal expenses if job time line is extended or changed weekly.
13) Payments to be made as follow: 50% Deposit at Time of Order; Balance of materials & Completed Labor upon receipt of Progress Invoice (see line 17 of T&C), Final Balance due upon completion. Invoices past due over 14 days will be charged a 1.5% weekly service charge. In cases of payment unreasonably withheld for merchandise delivered by Seller, Seller shall have a right to declare nonpayment a default of the terms of this Agreement and without further notice, may proceed to collect such defaulted payments by instituting legal action. Purchaser agrees that, should payment not be made in full according to the terms of this sales contract and/or any other breach of this contract occurs, Purchaser shall pay all reasonable attorney's fees and costs incurred in the collection of any sum due to Seller pursuant to this contract, regardless of whether legal actions are in fact instituted. This contract shall be governed by and constituted in accordance with the law of the State of California and venue shall vest in the courts of Santa Barbara, Santa Barbara County. Purchaser waives any right to have this action commenced, tried or removed to any other place.
14) Hardwood Flooring Customers: Note: Wood is a natural product subject to color, character and grain variations. Mineral streaks, knots, splits, cracks and other imperfections may also be present and are not considered defects of the hardwood floor. We cannot guarantee that the wood you order will exactly match sample boards because real wood is an organic material and will vary somewhat from tree to tree and board to board. It is strongly encouraged that customers purchase a carton of desired hardwood prior to installation in order to visualize a truer representation of what the hardwood will look like after installation. Use or installation constitutes acceptance and absolutely no adjustments or returns will be made thereafter.
15) Acceptance of Special Order Proposal: Purchase of the described merchandise on bid proposal at the price stated and receipt of a copy of this proposal are hereby acknowledged. The stated prices, specifications and conditions are satisfactory and hereby accepted. You are authorized to do the work in a substantial workmanlike manner. All of our orders are Special Orders and cannot be returned, canceled or refunded for any reason. This is for all materials (Flooring materials, sundries, trims, etc.) If canceled by customer, down payment will be forfeited to Michael Renga Flooring. Payment will be made as outlined above. Customers using a credit card to pay for special orders understand that they are nonreturnable and agree the bank will not be asked to make a charge back against our company for balances paid. Receipt of Floor covering installation guidelines acknowledged.
16) Customer is responsible for all materials once delivered to job site. MRF will not be responsible for Theft, Damage or Tampering.
17) If progress of job is partially completed, and not scheduled to be finished within 1 weeks time, a progress invoice will be submitted to customer. Customer agrees to not hold back progress PAYMENTS for any reason, under any circumstances.
